What is the purpose of reexamination review?
The purpose of reexamination review is to ensure the quality and completeness of the examiner’s actions in a reexamination case. According to MPEP 2689, the review process involves:
- Procedural review for compliance with reexamination statutes, regulations, policy, practice, and procedure
- Completeness review to ensure all issues and arguments are properly addressed
- Verification that all materials are present and correctly completed
As stated in the MPEP, “The CRU SPRS/TC QAS (with the aid of the paralegals or other technical support who might be assigned as backup) will then (A) procedurally review the examiner’s action for compliance with the applicable provisions of the reexamination statute and regulations, and with reexamination policy, practice and procedure, (B) do a completeness review of the action to ensure that all issues and arguments raised by all parties are appropriately developed, considered and addressed.”
