How can the order of inventors’ names be adjusted in an international design application?

The order of inventors’ names in an international design application can be adjusted according to specific procedures outlined in the MPEP 2920.01. The process is similar to correcting or updating an inventor’s name:

“The name of an inventor may be corrected or updated and the order of the names of the joint inventors may be adjusted in accordance with the provisions of 37 CFR 1.41(f).”

To adjust the order of inventors’ names, the following is required:

  1. An Application Data Sheet (ADS) that identifies each inventor by their legal name in the desired order
  2. The ADS must comply with 37 CFR 1.76
  3. The information being changed must be identified as required by 37 CFR 1.76(c)(2)
  4. Payment of the processing fee set forth in 37 CFR 1.17(i)
